Welcome to KAPOK ("the App"), operated by A Fair Resolution, LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you meet this age requirement.

2. Account Registration

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Information We Collect

Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6. Intellectual Property

All content, features, and functionality of the App — including text, graphics, logos, and software — are the property of A Fair Resolution, LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Third-Party Services

The App may contain links to or integrations with third-party services (including but not limited to Firebase and Mapbox). We are not responsible for the content, privacy practices, or availability of those services. Your use of third-party services is at your own risk.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, A FAIR RESOLUTION, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE REGARDLESS OF THE FORM, WILL BE LIMITED TO \$100 USD. CERTAIN STATES AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Indemnification

You agree to indemnify and hold harmless A Fair Resolution, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App or violation of these Terms.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of this page, sending you an email, or providing in-app notice. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
